This presentation will cover what employees must prove in order to have a valid retaliation claim; the basic “Dos” and “Don’ts” regarding prevention of retaliation claims, including how and when to document performance issues and employment decisions; and a checklist for best practices in performance management, with claim prevention in mind.
Our presenter will be Kyle Russell, Office Managing Principal for the Jackson Lewis law firm in Overland Park, KS.
Mr. Russell represents employers in administrative charges and lawsuits involving a wide variety of statutory and common law discrimination and retaliation cases. He also has extensive experience prosecuting violations of covenants not to compete by former employees. In addition to employment litigation, Mr. Russell has commercial litigation experience defending multi-district and state-law consumer class actions and governmental investigations.
Mr. Russell also has experience training managers on a wide variety of employment law issues, including harassment, discrimination, retaliation, wage and hour issues, implicit bias, workplace violence, social media, background checks, the Americans with Disabilities Act, and the Family & Medical Leave Act. He has also advised employers with respect to the implementation of nationwide arbitration agreement programs.
